Welcome to Algorithm Overland. This website is operated by Algorithm Overland LLC. Throughout the site, the terms "we", "us", and "our" refer to Algorithm Overland LLC. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions.

These Terms of Use govern your access to and use of the Algorithm Overland website located at algorithmoverland.com (the "Site"). If you do not agree to these Terms, please do not use the Site. These Terms will be updated as our products, services, and platform evolve.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence and have the legal capacity to enter into these Terms. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

If you are accessing the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You may use the Site for lawful, personal, non-commercial purposes only. You agree not to:

• Use the Site in any way that violates applicable local, national, or international laws or regulations.
• Attempt to gain unauthorised access to any part of the Site, its servers, or any related systems.
• Scrape, crawl, or systematically extract data from the Site without our prior written consent.
• Transmit any unsolicited or unauthorised advertising or promotional material.
• Introduce viruses, malware, or any other harmful code or technology.
• Impersonate Algorithm Overland, its team, or any other person or entity.

We reserve the right to terminate or restrict access to the Site for any user who violates these Terms.

By submitting your email address to join the Algorithm Overland waitlist, you consent to receive communications from us about product launches, pre-orders, brand updates, and related announcements. Joining the waitlist does not constitute a purchase, reservation, or guarantee of product availability.

You may opt out of communications at any time by clicking the unsubscribe link in any email we send, or by contacting us at hello@algorithmoverland.com. Opting out will not affect the lawfulness of any communications already sent.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email address and/or billing address or phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all transactions made through our store. You agree to promptly update your account and other information — including your email address, credit card numbers, and expiration dates — so that we can complete your transactions and contact you as needed.

All content on the Site — including but not limited to text, graphics, logos, images, product designs, and software — is the property of Algorithm Overland or its content suppliers and is protected by applicable intellectual property laws.

Algorithm Overland's proprietary hardware designs and utility innovations are protected under U.S. Patent Pending status. Nothing on this Site grants any licence or right to use our intellectual property without express written permission.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Site without our prior written consent.

The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Product specifications, availability, pricing, and release timelines shown on the Site are indicative only and subject to change without notice. Nothing on the Site constitutes a binding offer to sell.

To the fullest extent permitted by law, Algorithm Overland LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site or its content — even if we have been advised of the possibility of such damages.

Physical Products & Vehicle Use: Algorithm Overland LLC products are designed for rugged overlanding and vehicle storage applications. Proper securement and mounting are the sole responsibility of the user. We are not liable for any direct, indirect, incidental, punitive, or consequential damages, or personal injury resulting from improper installation, modification, or misuse of our equipment on any vehicle. Users assume all risk associated with vehicle modifications and off-road use.

Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed USD $100, or the amount paid for the relevant product, whichever is greater.

The Site may contain links to third-party websites or services (including our companion apps such as AO:Food, AO:RigFit, and AO:Land). These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated to waitlist members via email where appropriate. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.

This Addendum governs your use of the complimentary mobile applications offered by Algorithm Overland LLC (collectively, the "Apps"). By downloading or using any App, you agree to the following terms in addition to the main Terms of Use above.

A.1   "As-Is" License & No Support

The Apps are provided to Algorithm Overland customers free of charge as a discretionary, complimentary service on a strict "AS-IS" basis. Algorithm Overland LLC is under no obligation to provide technical support, bug fixes, updates, or maintenance for any App.

A.2   Discontinuation & Removal

Algorithm Overland LLC reserves the right to modify, suspend, or permanently remove any or all of the Apps from the Apple App Store at any time, without prior notice. We are not liable for any data loss, account deletions, or trail history losses resulting from app removal.

A.3   Complete Limitation of Liability & User Disclaimers

Outdoor exploration, vehicle modification, athletic conditioning, and backcountry cooking carry inherent risks of property damage, injury, or death. By using the Apps, you assume all risks. Algorithm Overland LLC, its officers, and partners are not liable for:

Creating an app account requires a valid email address. You explicitly agree to receive promotional and marketing communications regarding our hardware and ecosystem expansions. You may opt out of marketing at any time via the unsubscribe link included in every email.
